1. Acceptance of these Terms

These Terms of Use ("Terms") form a legally binding agreement between you and DestinyTara, operated from Monterrey, Nuevo Leon, Mexico. By creating an account, accessing, or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms, the Privacy Policy, and the Acceptable Use Policy.

Clicking the acceptance mechanism during registration is your electronic signature and express consent under the Mexican Codigo de Comercio, the US E-SIGN Act, and the EU eIDAS Regulation.

2. Service description

DestinyTara is a SaaS platform that uses AI and algorithmic analysis of the Qi Men Dun Jia classical mathematical framework to generate reflections on timing, personal context, and cultural symbolism. The Service is a cultural-analytics, personal-reflection, and digital-entertainment tool. It does not diagnose, prescribe, predict outcomes, or recommend specific decisions.

3. Eligibility — 18+ only

You must be at least 18 years old to use DestinyTara. The Service is not intended for, marketed to, or designed for minors. Users under the age of 18 are prohibited from creating an account, submitting birth data, or otherwise using the Service. If we discover that a user is under 18, we will terminate the account and delete associated data.

4. Account security

The Service uses passwordless One-Time Password (OTP) authentication via email. You are responsible for maintaining the security of your email account and for all activity under your account.

5. AI-generated content disclosure (EU AI Act Art. 50)

All analytical content you receive on DestinyTara is generated by an AI system applied to classical Chinese mathematical calculations. You are being informed that you are interacting with an artificial-intelligence system. The AI has no consciousness, sentience, intuition, or independent judgment, and its outputs must not be relied on as factual statements about the future, about any person, or about the physical world.

6. Prohibited uses

You agree that you will not use the Service:

• to make or influence medical, psychological, psychiatric, legal, or financial decisions, including decisions about medication, treatment, diagnosis, litigation, investing, or credit;
• to produce readings, charts, or interpretations about identifiable third parties without their informed consent (including partners, former partners, children, family members, coworkers, employees, clients, public figures, or any other named individual);
• to make decisions about another person's health, medication, relationships, finances, or welfare, including decisions affecting minors;
• in any jurisdiction or in any manner prohibited by local law, including laws requiring a fortune-telling, divination, psychic, or counseling license;
• to harm yourself or others, or to encourage, justify, or plan self-harm, violence, discrimination, or harassment;
• in any regulated professional context (medicine, psychology, psychiatry, therapy, law, financial advice, insurance) as a basis for advice you give to clients, patients, or the public, without your own independent professional judgment and disclosure that the output is AI-generated cultural content.

You are solely responsible for your use of outputs. Additional rules appear in our Acceptable Use Policy.

7. Territorial exclusions

The Service is offered only where it is lawful. You are not the intended user, and you must not use the Service, if you are located in:

• any US state or municipality that requires a license for fortune-telling, divination, psychic, or related services (for example, and without limitation, parts of New York, Maryland, and Virginia);
• Saudi Arabia, Iran, and other jurisdictions where divinatory or metaphysical content is restricted by law;
• mainland China, while we complete local compliance review.

By using the Service, you represent that you are not accessing it from a prohibited jurisdiction and that your use does not violate any law applicable to you.

8. Mental-health and crisis notice

DestinyTara is not a crisis, counseling, or mental-health service. If at any time you experience suicidal ideation, thoughts of self-harm, or a mental-health crisis, stop using the Service and contact a local crisis line or emergency services immediately. Example crisis resources:

9. Virtual credit system

Credits are non-monetary, non-transferable, revocable digital access licenses. They have no intrinsic monetary value, are not redeemable for cash, and may not be traded or sold. Once consumed, Credits are non-refundable.

10. Subscriptions & billing

Payments are processed through Stripe. Subscriptions renew automatically. In compliance with Mexico's PROFECO, we send renewal notices at least 5 days before each charge. You may cancel anytime with one click — no penalties, no retention tricks.

11. EU right of withdrawal

EU/EEA consumers have a 14-day right of withdrawal. This right may be waived upon explicit consent to immediate access to digital content during checkout, per EU Consumer Rights Directive Article 16(m).

12. No warranty — disclaimer

Results produced by DestinyTara are informational, non-deterministic, and reflective in nature. They are not predictions, diagnoses, prescriptions, or professional recommendations, and they come with no warranty of accuracy, predictive value, outcome, or fitness for any particular decision.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE, INCLUDING ALL AI-GENERATED CONTENT, CHARTS, TEXT, AND CALCULATIONS, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. DESTINYTARA DOES NOT WARRANT THAT OUTPUTS WILL BE TRUE, RELIABLE, OR SUITABLE FOR ANY DECISION, AND YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE SERVICE.

13. Limitation of liability

To the maximum extent permitted by applicable law, DestinyTara, its affiliates, officers, employees, agents, and suppliers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of, or inability to use, the Service, even if advised of the possibility of such damages.

DestinyTara's total aggregate liability for any and all claims arising out of or relating to the Service in any twelve (12) month period is capped at the amount you actually paid to DestinyTara for the Service during the twelve (12) months preceding the event giving rise to the claim. Where that amount is zero, the cap is US$100.

14. Binding individual arbitration; class-action waiver

To the maximum extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved exclusively by binding, individual arbitration, and not in a court of general jurisdiction. The arbitration will be administered under the rules of the ICC International Court of Arbitration or ICDR, with the seat of arbitration in Monterrey, Nuevo Leon, Mexico, in English or Spanish at the claimant's election. Judgment on the award may be entered in any court of competent jurisdiction.

You and DestinyTara each waive any right to participate in a class, collective, representative, or consolidated action. Disputes must be brought in an individual capacity only. Nothing in this clause prevents either party from seeking injunctive relief in court for intellectual-property misuse, and nothing limits non-waivable consumer rights under applicable law.

15. Governing law and venue

These Terms are governed by the laws of the United Mexican States, without regard to conflict-of-law principles. Subject to Section 14, the exclusive venue for any action not subject to arbitration is the competent courts of Monterrey, Nuevo Leon, Mexico. This choice does not deprive consumers of mandatory protections of their country of residence.

16. Enforcement

We may suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms or the Acceptable Use Policy, or if continued use creates legal, safety, or security risk. Termination for violation may occur without refund.
